Yunnan Traditional Craft Revitalization Action Plan

  In order to conscientiously implement the spirit of the Notice of the General Office of the State Council on Forwarding the China Traditional Craft Revitalization Plan of the Ministry of Culture and other departments (Guo Ban Fa [2017] No.25), strengthen the protection of intangible cultural heritage, revitalize traditional crafts, and combine the reality of our province, this plan is formulated.

  The traditional craft mentioned in this plan refers to the production craft and related products with historical inheritance and national or regional characteristics, which are closely related to daily life and mainly use manual labor. It is a creative manual labor and individualized production, which has irreplaceable characteristics in industrial production, mainly including representative projects of intangible cultural heritage such as traditional skills, traditional fine arts and traditional medicine processing.

  I. Significance

  Traditional craft contains Chinese cultural values, ideological wisdom and practical experience, and is an important part of intangible cultural heritage. Revitalizing traditional crafts is conducive to inheriting and developing excellent traditional cultures of all ethnic groups and enhancing cultural self-confidence; It is conducive to improving the enthusiasm of traditional craft inheritors and cultivating subsequent talents; It is conducive to stimulating creative vitality and inheriting endangered or degraded excellent technologies and elements; It is conducive to giving full play to the creativity of manual labor and cultivating and promoting the craftsman spirit of Excellence; It is conducive to expanding employment and entrepreneurship in urban and rural areas, promoting cultural consumption, achieving precise poverty alleviation and boosting rural revitalization.

  The traditional crafts in our province have a long history and various categories. There are nearly 150 traditional crafts in the national and provincial intangible cultural heritage representative projects. Our province is a province that put forward and implemented the folk craft of "Jin Mu Earth-Rock Cloth" as the core format earlier to promote the development of local cultural industry. Implementing the traditional craft revitalization plan is of great significance to promoting the construction of a strong province of ethnic culture and creating a world-class "healthy living destination card".

  Second, the overall requirements

  (1) Guiding ideology. Guided by the Supreme Leader’s Socialism with Chinese characteristics Thought in the New Era, we should fully implement the spirit of the 19th National Congress of the Communist Party of China, follow the guidelines for the protection of intangible cultural heritage, improve the inheritance ability and level of intangible cultural heritage, promote the rational utilization of intangible cultural heritage resources, make traditional crafts enter the contemporary society, integrate into modern life, and fully reflect the creative value of manual labor.

  (2) Basic principles. Adhere to the basic principles of organic unity of intangible cultural heritage protection and utilization, creative transformation and innovative development of traditional culture, so that traditional crafts can be widely used in modern life. Respect the excellent national traditional culture, adhere to the craftsman spirit, stimulate creative vitality, promote employment and increase income, and adhere to green development.

  (3) Work objectives. By 2020, the inheritance and innovation ability, industry management level, market competitiveness and the promotion of urban and rural employment of traditional crafts will be significantly improved, and a number of traditional craft themes and product varieties will be formed, and a number of well-known brands with high design and production levels will be cultivated, and a group of talents with strong inheritance and innovation ability will be cultivated. Announce 30 provincial-level catalogues of traditional crafts revitalization, and strive to achieve more than 14 national-level catalogues of traditional crafts revitalization, with more than 20 representative inheritors of national intangible cultural heritage of traditional crafts and more than 130 representative inheritors of provincial-level intangible cultural heritage of traditional crafts; There are more than 5 masters of arts and crafts in China and more than 100 masters of arts and crafts in Yunnan.

  III. Main tasks

  (a) the establishment of provincial traditional craft revitalization directory. Based on the list of representative projects of provincial intangible cultural heritage, establish a provincial catalogue of traditional craft revitalization for traditional craft projects with certain inheritance foundation and production scale, promising development prospects, helping to promote employment and accurate poverty alleviation. Dynamic management of projects listed in the provincial revitalization catalogue, and key support for endangered projects.   (2) Strengthen the team of traditional craft inheritors. Improve the declaration, evaluation and management system of representative inheritors of representative intangible cultural heritage projects at the provincial, prefecture and county levels. Encourage young and middle-aged inheritors of skilled and qualified traditional crafts to declare and enter the representative inheritors of representative projects of intangible cultural heritage at all levels, mobilize the enthusiasm of the younger generation to engage in traditional crafts, and form a reasonable talent echelon. Encourage the establishment of intangible cultural heritage workshops (institutes, rooms and spots) or studios for masters and famous artists, and support the representative inheritors of intangible cultural heritage of traditional crafts and masters of arts and crafts to teach with apprentices and cultivate successors. Teaching artists with apprentices and improving the quality of works are the contents of the assessment of representative inheritors of intangible cultural heritage of traditional crafts.   (3) Strengthen the training of people who inherit traditional crafts. Relying on Yunnan University, Yunnan University for Nationalities, Yunnan Art College, Dali University, Yunnan Vocational College of Culture and Art, Yunnan Technician College and other institutions of higher learning and intangible cultural heritage training bases, organize traditional craft holders, practitioners and other inheritors to participate in research, study and training, improve their learning ability, cultural literacy, aesthetic level and innovation awareness, and enhance their inheritance potential. Organize outstanding inheritors, craftsmen, design and management personnel to carry out roving lectures at the location of traditional craft projects, and hold a series of activities of "inheritor dialogue" to expand the training of inheritors.   (four) to strengthen the construction and research of traditional craft related disciplines. Support qualified colleges and universities, vocational colleges and technical colleges to set up traditional craft-related majors and courses, and cultivate traditional craft professionals with technical skills and theoretical research talents. Support qualified vocational colleges to strengthen the construction of traditional craft specialty and cultivate technical and technical talents with good cultural and artistic quality. Actively promote the modern apprenticeship system, build a number of skill master studios, and encourage representative inheritors of intangible cultural heritage of traditional crafts to participate in vocational education and research. Support qualified institutions of higher learning to help people who inherit traditional crafts improve their academic level. Encourage institutions of higher learning, research institutions and enterprises to set up traditional craft research bases and key laboratories. On the basis of maintaining excellent traditions, explore the organic integration of handicraft skills with modern science and technology, process equipment, improve the level of material handling, and effectively strengthen the transformation of achievements. Relying on the research base of intangible cultural heritage in our province, we will strengthen the excavation, recording and arrangement of traditional crafts. For endangered traditional craft projects with unique historical significance, we will speed up the implementation of rescue records and implement protection and inheritance measures.   (5) Improve the overall quality and market competitiveness of traditional craft products. Encourage enterprises, universities and relevant units with strong design capabilities to set up workstations in traditional craft projects in our province to help local traditional craft enterprises and practitioners solve technological problems and enhance their awareness of quality, quality, brand and market; Combined with the needs of modern life, we should improve design, materials and production, introduce modern management system, carry out extensive quality improvement actions, comprehensively strengthen quality management, improve product design and production level, improve product quality, expand the market, and cultivate well-known brands of traditional crafts with national characteristics. Encourage practitioners of traditional crafts to sign their works or products or use their hands as signs, and support the development of modern handicrafts based on manual labor and rich cultural connotations. Encourage traditional craft enterprises and practitioners to rationally use the intellectual property system, register product trademarks, and protect trade secrets and innovations. Support qualified regions to register geographical indication certification trademarks or collective trademarks. Cultivate 10 well-known brands of traditional crafts with national characteristics; Seriously run Dali traditional craft workstation, and promote experience from point to area; Establish provincial-level traditional craft workstations in mature States and cities to expand demonstration and guidance. Encourage the establishment of exhibition and sales places for traditional craft products in historical and cultural blocks, villages and towns, natural and cultural scenic spots and traditional craft projects where traditional crafts are concentrated, and focus on displaying, publicizing and promoting traditional craft products with national or regional characteristics. In the "Cultural and Natural Heritage Day", intangible cultural heritage exhibitions, cultural industry fairs, tourism promotion and other festivals and exhibitions, traditional craft exhibitions will be held, and more exhibition and trading platforms will be built to help promote and sell traditional craft products. Make full use of platforms such as "One Mobile Phone Tour Yunnan" and "Cultural Yunnan Cloud" to provide e-commerce services and broaden the promotion, display and sales channels of traditional craft products. Give full play to the role of industry organizations and expand the cooperation channels of traditional crafts in design and development, exhibition sales and technical support.   (seven) focus on promoting key projects for the revitalization of traditional processes. Make full use of the advantages of intangible cultural heritage resources in our province, and combine the distribution and inheritance of traditional crafts in our province to determine a number of key projects and give them support. Through content innovation and scientific and technological innovation, efforts will be made to promote the all-round cooperation between Dali Bai Tie-dyeing, Jianchuan Woodcarving and Heqing Silverware, three national intangible cultural heritage inheritors (Dali Puzhen Bai Tie-dyeing Co., Ltd., Jianchuan Xingyi Classical Woodcarving Furniture Factory, Heqing Li Xiaobai Cultural Heritage Co., Ltd.) and the Central Academy of Fine Arts and Yunnan Art College. Promote the development of traditional craft projects such as embroidery, brocade, batik, purple pottery, black pottery, black copper and silver, hand-made paper, stone carving and jade carving in our province. Actively explore effective ways of "non-legacy+poverty alleviation", intensify the revitalization of traditional crafts in poverty-stricken areas, support poverty-stricken areas to explore the establishment of poverty-stricken employment workshops for intangible cultural heritage, and give full play to the role of traditional crafts in helping accurate poverty alleviation.(The Provincial Department of Culture takes the lead; Provincial Cultural Products Office, Provincial Industry and Information Technology Commission, Education Department, Finance Department, Poverty Alleviation Office, with the cooperation of state and municipal people’s governments)

  (eight) to strengthen the protection of cultural and ecological environment related to traditional crafts. The towns, villages and blocks with concentrated traditional crafts in our province are evaluated and screened, and the overall protection is implemented through the construction of national traditional cultural and ecological protection zones. In the construction of two national cultural and ecological protection experimental zones, Diqing National Cultural and Ecological Protection Experimental Zone and Dali Cultural and Ecological Protection Experimental Zone, and 85 provincial national traditional cultural and ecological protection zones, attention should be paid to protecting the cultural space and ecological environment related to traditional crafts. Strengthen the protection of the ecological environment, encourage the research and development of green materials, improve the technological process, reduce the total discharge of pollutants, and ensure that the discharge reaches the standard.   (nine) to carry out the popularization of traditional crafts education and exchanges and cooperation. Vigorously carry out activities such as intangible cultural heritage entering the campus, classroom, teaching materials, community and rural areas. Support schools to organize and carry out traditional craft experiences and competitions that reflect regional and national characteristics, improve young people’s hands-on ability and creativity, and deepen their understanding of traditional crafts. Give full play to the role of cultural centers, libraries, museums, etc. at all levels, and carry out activities such as exhibitions, experiences, lectures, trainings, etc. of traditional crafts for communities and rural areas, so as to enrich the cultural life of the masses and enhance the social identity of traditional crafts. Vigorously organize representative inheritors of intangible cultural heritage of traditional crafts to participate in expositions, exhibitions or exhibition activities. Organize representative inheritors, enterprises and industries of intangible cultural heritage of traditional crafts.Organize representatives to carry out international exchanges and training for countries all over the world, especially South Asia and Southeast Asia.   Fourth, safeguard measures

  (1) Strengthen cooperation and cooperation. Governments at all levels should attach great importance to it, strengthen overall coordination and cooperation, take the revitalization of traditional crafts as an important part of the development and prosperity of cultural undertakings and industries, fully tap and utilize national cultural resources in our province, give play to the typical leading role of production protection demonstration bases and traditional craft workstations, strengthen the protection and inheritance of traditional crafts, and actively explore effective ways and methods to revitalize traditional crafts.(State and municipal people’s governments are responsible)

  (2) Improve policy support. Make use of existing capital channels to give appropriate support to projects related to traditional crafts that meet the requirements and the development of traditional crafts in characteristic cultural industries. Incorporate the infrastructure construction of traditional craft display and learning into the cultural tourism promotion project during the 13 th Five-Year Plan period.   (3) Strengthening financial services. Encourage financial institutions to develop financial products and services suitable for the characteristics of traditional craft enterprises, and strengthen investment and financing support and services for traditional craft enterprises. Guide banks to carry out pledge loans such as equity, warehouse receipts and accounts receivable, and support traditional craft enterprises to use credit enhancement measures such as guarantee and insurance to reduce their dependence on fixed assets mortgage. Encourage qualified traditional craft enterprises to directly raise funds in the capital market, and encourage insurance funds to support traditional craft enterprises on the premise of compliance with laws and regulations. There are many similar cases in the past, which can be used as reference.

Adblock Plus (hereinafter referred to as ABP), an advertising blocking plug-in in Germany, has been sued many times, basically for "constituting unfair competition".

In these cases, ABP has lost and won.

In 2015, ABP was considered as unfair competition by the Frankfurt state court and ruled that a temporary injunction was issued.

In 2018, Springer, the publisher of Le Monde, filed a lawsuit against ABP, and the German Supreme Court ruled that ABP did not violate the competition law.

People’s courts think that users have the right not to watch advertisements, just like advertisements in newspapers and magazines, and everyone can choose to ignore or turn pages.

After a year, Springer said that ABP infringed, and sued again in a different posture, but ABP still won.

The court will generally pay attention to two key factors-subjective will and degree of influence.

For example, in 2016, the court in Cologne, Germany, ruled that ABP itself did not violate the competition law (but other aspects lost), mainly saying two points.

First, ABP is not targeted to hinder others.

ABP is an open source software, which filters the advertisements of corresponding websites according to the list.

Note, however, that the list is public and can be modified and used by anyone.

ABP only intercepts content according to the list provided by users.

To make an inappropriate analogy, whether a kitchen knife is bought to cut vegetables or people depends on the buyer’s subjective will, and the kitchen knife is only responsible for "cutting".

Therefore, ABP is technology neutral and does not hinder others.

Second, ABP did not harm others excessively.

The court held that although ABP affected the plaintiff’s model: advertising+free content, there was no evidence that the plaintiff could not provide content without advertising. In addition, the plaintiff already has the technology to block users who use plug-ins.

This means that ABP does not affect other people’s business models too much.

There are similar cases in China.

In 2015, ADsafe was sued by Aiqiyi and PPTV, and violated the Anti-Unfair Competition Law by "infringing on others’ legitimate business model and making profits for themselves without justifiable reasons".

In 2019, Window of the World browser was sentenced to violate recognized business ethics for blocking Tencent video advertisements, which constituted unfair competition and compensated 1.89 million yuan.

In the same year, 720 browser was judged as unfair competition for intercepting and blocking mango TV advertisements, and compensated 800,000 yuan.

Although the legal provisions at home and abroad are different, the key points of such cases are quite consistent.

Blocking advertisements like 720 browser is actually a built-in ABP plug-in, which emphasizes that it is technology neutral in court.

However, the court held that he did not simply provide users with ABP technology for the benefit of users, but increased the browser’s own resources and sought more trading opportunities.

What he said about "technology neutrality" is obviously inconsistent with the facts.

The plot of the Window of the World browser case is also quite ups and downs.

At the first trial, the court held that Window of the World browser did not target Tencent video and did not cause fundamental damage, so it did not constitute unfair competition.

Later, Tencent refused to accept the appeal.

The court of second instance held that the browser violated the Interim Measures for the Administration of Internet Advertising in 2016.

"Internet advertising activities shall not provide or use applications, hardware, etc. to intercept, filter, cover, fast-forward and other restrictions on other people’s legitimate advertisements. 」

The court said that even if this provision is not considered, it is also an act of taking the initiative to directly intervene and intervene in other people’s business operations, which violates recognized business ethics and violates the anti-unfair competition law.

In addition, the court also held that Window of the World browser destroyed people’s business model, which would not only harm the interests of consumers, but also endanger the development space of online video industry in the long run.

So to sum up, the key points of this kind of cases are technical neutrality, subjective will, whether it has a far-reaching impact, and whether it violates the law and recognizes business ethics.

After reading the past cases, let’s go back to Li Tiaotiao.

The revision in 2017 expanded the scope of operators from the perspective of "behavioral characteristics", from the original "commodity management or profit-making services" to "commodity production, management or service provision", and the providers of commodity production and non-profit services were also included in the scope of operators.

Therefore, even if Li Tiaotiao is not profitable, he may be an operator, and his subjective will constitutes "unfair competition."

Of course, whether Li Tiao Tiao constitutes unfair competition law or not, at the end of the story, Li Tiao Tiao all chose to stop the watch indefinitely. . .

I don’t think people need to feel too bad.

First, as long as there is an installation package, you can continue to use it, but the App can’t be updated and maintained later.

Second, we should be clear about what phenomenon Li Tiaotiao is the product of.

Provincial statistical agencies are responsible for the application, review and management of statistical law enforcement certificates in their own regions and systems.

Article 6 The statistical law enforcement certificate consists of a special wallet and an internal card.

The wallet is horizontal black leather, with the words "People’s Republic of China (PRC)" engraved on the upper part of the external front, the national emblem engraved in the middle and the words "Statistical Law Enforcement Certificate" engraved on the bottom, the logo of the National Bureau of Statistics engraved on the middle of the back and the words "Issued by the National Bureau of Statistics" engraved on the bottom; Internal card is placed.

The left side of the card in the statistical law enforcement certificate is an anti-counterfeiting plastic package card, which is marked with the words "People’s Republic of China (PRC) Statistical Law Enforcement Certificate" and the law enforcement certificate number, the name, gender, photo, unit, issuing authority, expiration date and the seal of the National Bureau of Statistics of the holder, and the right side is a paper card, which indicates the duties, authority and supervision telephone number of law enforcement personnel.

If the state has special provisions on the system of law enforcement certificates, those provisions shall prevail.

 

Chapter II Acquisition and Issuance of Certificates

Article 7 To obtain a statistical law enforcement certificate, the following conditions shall be met:

(a) firm ideals and beliefs, and resolutely implement organizational decisions;

(two) adhere to principles, decent style, loyal to their duties, law-abiding;

(3) Having the necessary legal knowledge and mastering the contents of statistical laws, regulations and relevant administrative laws and regulations;

(four) have the necessary statistical business knowledge, familiar with the main contents of the statistical investigation system;

(five) master the statistical law enforcement process and discipline;

(6) Other conditions stipulated by laws, administrative regulations and rules.

Article 8 To obtain a statistical law enforcement certificate, one shall meet the following qualifications:

(a) the civil servants in the statistical agencies of the people’s governments at or above the county level or the staff managed by reference to the Civil Service Law of People’s Republic of China (PRC), and intend to engage in statistical law enforcement;

(2) Having a college degree or above;

(3) HavingthreeAt least years statistical work experience, or have a bachelor degree or above in law and haveoneAt least years working experience in statistics, or working in a statistical legal institution.oneYears or more;

(four) to participate in statistical law enforcement training organized by statistical agencies at or above the provincial level, and to pass the qualification examination for statistical law enforcement personnel.

Article 9 Persons in any of the following circumstances shall not issue statistical law enforcement certificates:

(1)threeThe annual assessment results during the year are incompetent;

(two) there are illegal records in statistical work;

(3) Being punished for violating statistical laws and regulations;

(4) Being severely punished by Party discipline and government affairs for violating discipline and being in the period of punishment influence.

Article 10 Provincial, municipal and county statistical agencies applying for statistical law enforcement certificates shall submit the following materials to the statistical law enforcement agencies at or above the provincial level who intend to issue statistical law enforcement certificates:

(a) the application form for statistical law enforcement certificate;

(two) the appointment and removal of cadres;

(three) a copy of the academic certificate;

(four) the proof materials of the statistical institution about education, establishment, position and annual assessment results;

(five) the statistical agency’s certification materials on legal knowledge, statistical business knowledge, law enforcement ability level and no circumstances listed in Article 9 of these Measures.

Article 11 Statistical institutions shall conduct a preliminary examination of the persons who intend to issue statistical law enforcement certificates in accordance with the provisions of Articles 7, 8 and 9 of these Measures. To meet the conditions and qualifications, the statistical agencies shall collectively study and determine the list of persons who intend to issue statistical law enforcement certificates in accordance with the provisions of the conference system, sign the review opinions in the corresponding columns of the Application Form for Statistical Law Enforcement Certificates and affix the official seal of the unit, and submit them to the provincial statistical agencies for review.

Article 12 Provincial statistical law enforcement agencies shall, after receiving the Application Form for Statistical Law Enforcement Certificate, conduct an audit in accordance with the provisions of the present Measures. Those who meet the conditions and qualifications shall be submitted to provincial statistical agencies for collective research in accordance with the provisions of the conference system to determine the personnel who intend to issue statistical law enforcement certificates, and shall be reported to the Statistical Law Enforcement Supervision Bureau of the National Bureau of Statistics for examination and approval, and a statistical law enforcement certificate shall be issued by the National Bureau of Statistics.

Article 13 All units of the National Bureau of Statistics apply for statistical law enforcement certificates, and the division-level institutions shall examine the personnel who intend to issue statistical law enforcement certificates according to the provisions of Articles 7, 8 and 9 of these Measures. Those who meet the conditions and qualifications shall sign the examination opinions in the corresponding columns of the Application Form for Statistical Law Enforcement Certificates and affix the official seal of the unit, and submit them to the Statistical Law Enforcement Supervision Bureau. The Bureau of Statistical Law Enforcement Supervision shall conduct an audit in accordance with the provisions of these Measures and collectively study and determine the list of persons who intend to issue statistical law enforcement certificates, and report to the leaders of the National Bureau of Statistics for examination and approval.

 

Chapter III Statistical Law Enforcement Training and Examination

 

Article 14 The National Bureau of Statistics is responsible for organizing the formulation of the national statistical law enforcement personnel training plan and formulating the training outline.

Statistical institutions at or above the provincial level shall, in accordance with the training plan, organize on-the-job training for statistical law enforcement personnel.

Article 15 Statistical law enforcement post training is divided into qualification training and on-the-job training. The training contents include statistical laws and regulations, relevant administrative laws and regulations, policy theory, statistical professional knowledge, on-site law enforcement practice, party discipline and work system, etc.

Article 16 The training teachers for statistical law enforcement posts should be statistical rule-of-law workers, statistical business backbones, legal experts, personnel with rich law enforcement experience and skilled law enforcement skills in the National Bureau of Statistics, provincial statistical agencies and the talent pool of law enforcement backbones of the National Bureau of Statistics.

Article 17 The Statistical Law Enforcement Supervision Bureau of the National Bureau of Statistics is responsible for formulating the qualification examination outline for statistical law enforcement personnel and establishing the examination question bank.

Statistical institutions at or above the provincial level shall, in accordance with the examination syllabus, be responsible for organizing statistical law enforcement officers in their own regions and systems to conduct qualification examinations according to the examination questions provided by the Statistical Law Enforcement Supervision Bureau of the National Bureau of Statistics, and implement unified proposition, unified paper making and unified marking.

Article 18 The qualification examination of statistical law enforcement personnel includes basic legal knowledge, statistical laws and regulations, relevant laws and regulations, professional knowledge of statistical law enforcement and other related knowledge.

Article 19 Statistical institutions at or above the provincial level shall, in strict accordance with the provisions of the National Bureau of Statistics, organize the implementation of qualification examinations to ensure that reference personnel strictly abide by the examination room discipline.

Article 20 Statistical institutions at or above the provincial level shall organize and carry out job training and qualification examinations for statistical law enforcement personnel free of charge.

Article 21 Statistical institutions at or above the provincial level shall strengthen the management of certified personnel, establish a statistical law enforcement certificate database and implement dynamic management.

Provincial statistical agencies shall regularly report the use of statistical law enforcement certificates in their own regions and systems to the National Bureau of Statistics for the record.

Article 22 Statistical institutions at or above the provincial level shall announce the names of the holders of statistical law enforcement certificates, their units, law enforcement certificate numbers and other information to the public through government websites for public inquiry.

Article 23 Statistical law enforcement certificates shall be uniformly printed by the National Bureau of Statistics, and shall be numbered uniformly throughout the country.

Statistical law enforcement certificate issued by the National Bureau of Statistics. From the date of issuance of the statistical law enforcement certificate,fiveValid during the year. The holder shall use the statistical law enforcement certificate in accordance with the statutory authority, and shall not alter, copy, lend, mortgage, give away, buy or sell or intentionally damage it, and shall not use the statistical law enforcement certificate for non-statistical law enforcement activities.

Article 25 The holder shall properly keep the statistical law enforcement certificate to prevent it from being lost, stolen or damaged.

If the statistical law enforcement certificate is lost, stolen or damaged, the holder shall promptly report to the unit where he works, and the unit where he works shall apply to the original issuing authority for a replacement according to the application procedures. The unit to which the holder belongs and the issuing authority shall promptly invalidate the announcement of the lost, stolen or damaged statistical law enforcement certificate.

Article 26 If the holder has any of the following circumstances, the unit to which he belongs shall recover his statistical law enforcement certificate and submit it to the issuing authority for cancellation after being audited by the provincial statistical agency:

(1) Retirement;

(2) Resignation and dismissal;

(three) no longer engaged in statistical law enforcement work;

(four) the statistical law enforcement certificate expires;

(5) It shall be withdrawn for other reasons.

Article 27 The National Bureau of Statistics shall supervise and inspect the application, issuance, management and use of statistical law enforcement certificates.

Chapter vi Legal liability

 

Article 30 Certified personnel in any of the following circumstances, by the statistical agencies at or above the provincial level criticism and education, shall be ordered to make corrections, can be withheld its statistical law enforcement certificate:

(a) beyond the statutory authority or in violation of legal procedures for law enforcement, without causing serious consequences;

(two) the use of statistical law enforcement certificates for non-statistical law enforcement activities has not caused serious consequences;

(three) suspected of violating discipline and law has been put on file for review, and no conclusion has been made;

(four) other reasons should be withheld.

Article 31 In any of the following circumstances, the statistical agencies at or above the provincial level shall collect their statistical law enforcement certificates:

(a) beyond the statutory authority or in violation of legal procedures for law enforcement, resulting in serious consequences;

(two) the use of statistical law enforcement certificates for non-statistical law enforcement activities, resulting in serious consequences;

(three) alter, copy, lend, mortgage, give away, buy or sell or intentionally damage the statistical law enforcement certificate;

(four) taking advantage of his position, asking for accepting other people’s property, collecting fines for himself or engaging in other illegal activities;

(five) there are malpractice, dereliction of duty and other dereliction of duty;

(six) the annual assessment results are incompetent;

(7) Being punished by administrative detention, criminal detention or sentenced to punishment;

(eight) refusing or obstructing statistical law enforcement inspection, shielding or conniving at statistical violations;

(9) being punished by party discipline and government affairs;

(ten) other circumstances in which the statistical law enforcement certificate should be confiscated.

Article 32 Any unit that, in violation of the provisions of these measures, forges, alters or fraudulently uses statistical law enforcement certificates shall be ordered by the National Bureau of Statistics or provincial statistical agencies to make corrections, given a warning and may be notified; If the directly responsible person in charge and other directly responsible personnel belong to national staff, the appointment and removal organ or the discipline inspection and supervision organ shall punish them in accordance with the relevant provisions.

Article 33 In violation of these measures, making and issuing statistical law enforcement certificates without authorization shall be ordered by the National Bureau of Statistics to make corrections, give a warning and be informed; If the directly responsible person in charge and other directly responsible personnel belong to national staff, the appointment and removal organ or the discipline inspection and supervision organ shall punish them in accordance with the relevant provisions.

Article 34 In violation of the provisions of these measures, which constitutes a violation of public security administration, the public security administration shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

 

Chapter VII Supplementary rules

 

Article 35 These Measures shall come into force as of the date of promulgation.

  The reform area of "one certificate with multiple addresses" covers Yizhuang New City (225 square kilometers). The application for "one certificate with multiple addresses" shall be initiated by a food chain operation enterprise and meet all the following conditions:

  1. The food chain enterprises set up new direct-operated stores in Yizhuang New Town or change or extend the existing direct-operated stores;

  2. The food chain enterprises are registered in Beijing, and there are more than 10 direct stores in Beijing;

  3. Use a unified trade name (shop name), implement unified procurement and distribution, and standardize business management in Beijing, and have a sound quality management system and professional management team;

  4. The business items, process layout, equipment and facilities between the direct stores and the food chain enterprises, and between the direct stores are the same or similar;

  5. Food chain enterprises shall meet the basic conditions for engaging in food business as stipulated in the Food Safety Law of People’s Republic of China (PRC), the Measures for the Administration of Food Business License and the Measures for the Administration of Food Business License in Beijing (for Trial Implementation).

  For large-scale and above catering operators, central kitchens, collective dining distribution units and other main formats that undertake group dinners, enterprises with high risk levels and poor credit feedback from regulatory and law enforcement departments, enterprises with serious bad credit records or enterprises that have made false promises and their credit has not been repaired, the reform of "one license and multiple addresses" is not applicable.

  Where national laws, regulations and rules clearly stipulate, such provisions shall prevail.

  Third, the handling process

  (1) Application and qualification examination

  In accordance with the principle of voluntariness, food chain enterprises apply for the qualification of "one license and multiple addresses" through the online "one license and multiple addresses" area or offline government service hall of Beijing Municipal Affairs Service Network (the government website of Economic Development Zone), and the examination and approval department will review the basic situation, standardized operation and management, food safety management system and public credit of the enterprise according to the relevant requirements of this scheme. When necessary, the examination and approval department may request the local market supervision department to assist in providing supervision and law enforcement information as a review reference. Food chain enterprises can apply for qualification separately, or they can apply at the same time when they newly open, change or extend direct-operated stores.

  (two) issued a "comprehensive license qualification certificate"

  After passing the qualification examination, the examination and approval department will issue the Comprehensive License Qualification Certificate to the food chain enterprises, and grant them the qualification of "second batch" when opening direct-operated stores or changing or extending existing direct-operated stores in the region. In principle, the validity period is 5 years, and it will be adjusted timely with the validity period of the food chain enterprises’ licenses and the promotion of reform. For food chain enterprises that have not applied for qualification examination or failed to pass the examination, they shall still be handled according to the general licensing procedures.

  (3) Newly opened/changed/extended direct-operated stores

  Within the validity period of the Comprehensive License Certificate, food chain enterprises can choose the general license method or the "one license and multiple addresses" method to handle the change and extension of new or existing direct stores in the region. When the "one license and multiple addresses" method is selected, the examination and approval department will implement the "second batch" through prior technical guidance, and record the information of direct stores in the QR code of the Comprehensive License Qualification Certificate.

  (4) Trustworthy verification

  The examination and approval department shall, within 20 working days from the date of granting the license, carry out on-site inspection of newly opened, changed (business scope) or extended direct-operated stores, focusing on checking whether the actual situation of food business is consistent with the contents of the declaration and whether the food business conditions meet the requirements. If there is any discrepancy with the contents of the declaration, it shall be ordered to make rectification within a time limit. If it fails to meet the requirements after rectification or refuses to make rectification within the time limit, the licensing decision of the direct-operated store shall be revoked; If an administrative license is obtained by cheating or other improper means, the licensing decision shall be revoked directly. To make a cancellation decision, it is necessary to adjust the store information in the QR code of the Comprehensive License Qualification Certificate. Unified filing management shall be implemented for all materials formed in the process of "one certificate with multiple addresses".

  (E) the implementation of a number of reform measures superimposed

  The qualification examination of food chain enterprises and the "second batch" examination decision of direct-operated stores shall be included in the scope of the "Chief Examiner". The examination and approval department carries out qualification examination and trustworthiness verification, and uses the "cloud reconnaissance" method to improve the examination and approval efficiency; The business license of a direct store and "one license and multiple addresses" can be handled simultaneously to realize "license joint office". If a number of reform measures are superimposed, the materials will be promoted to be reused and the application materials will be streamlined to the greatest extent.

  (VI) Linkage of examination, management and execution

  To strengthen data sharing, the examination and approval department shall promptly push the handling of "one license and multiple addresses" to the post-event supervision and law enforcement departments, which shall carry out supervision and law enforcement work on direct-operated stores in accordance with the relevant requirements of food business management norms; For all the direct-operated stores opened by food chain enterprises in the area, the supervision and law enforcement departments regularly carry out joint inspections. If there are major operational risks in the work, they should promptly inform the examination and approval department, and if other areas are involved, they should also inform the local market supervision department.

  (VII) Risk credit supervision

  Food chain enterprises have major risks, serious dishonesty, major illegal acts, major social adverse effects, etc., which are not suitable for the reform of "one license with multiple addresses" or cannot meet the conditions stipulated in this scheme, their "one license with multiple addresses" qualification will be cancelled and the "Comprehensive License Qualification Certificate" will be withdrawn. Relevant information is pushed to the regulatory, law enforcement departments or local market supervision departments.

  (8) Alteration, extension and cancellation of the Comprehensive License Qualification Certificate.

  1. change. If the information on the face of the certificate changes, the examination and approval department shall issue a new certificate for it. If the main format and business items of a food chain operation enterprise are changed, the qualification examination shall be re-conducted.

  2. Continuation. Food chain enterprises can apply for qualification renewal 30 working days before the expiration of the "Comprehensive License Qualification Certificate". Those who fail to apply within the time limit need to re-examine their qualifications.

  3. Write off. Applicants can apply for cancellation. If the food chain business enterprise fails to apply for the extension of the "Comprehensive License Qualification Certificate" at the expiration of the validity period, the examination and approval department shall cancel it and inform the relevant supervision and law enforcement departments.

  If the substantive contents such as the layout of the process flow of food chain enterprises change, which may affect the implementation of the reform of "one license and multiple addresses", it shall promptly inform the examination and approval department and handle it in accordance with the above-mentioned relevant processes.

  Fourth, the job requirements

  (a) to strengthen publicity and guidance, and actively promote the implementation. All departments should attach great importance to it, take effective measures, do a good job in policy propaganda and guidance, and steadily and orderly promote the implementation of "one certificate with multiple addresses".

  (two) the implementation of job responsibilities, according to the law and orderly progress. The administrative examination and approval bureau should earnestly assume the main responsibility of the reform work and steadily push forward various reform tasks in accordance with the time sequence. Constantly improve the reform content and ensure that the reform measures are implemented.

  (three) do a good job of communication and coordination, timely summary and evaluation. Do a good job in communication and coordination in the process of reform, and summarize in time according to the progress. The relevant departments should strengthen the training of relevant personnel, do a good job summary in time, and evaluate the implementation effect.

  V. Supplementary Provisions

  This plan was formally implemented as of the date of promulgation, and the Implementation Plan of Beijing Economic and Technological Development Zone on the Pilot Reform of "One Certificate and Multiple Access" for Food Chain Enterprises (JJTG [2022] No.58) was abolished at the same time.
